Adam Deitch Drum And Hip-Hop Breaks Sample Pack License Agreement Terms & Conditions
The following terms and conditions ("Agreement") apply to all purchases of drum music breaks, loops, samples, and sound packs ("Products") from Adam Deitch Official Webstore ("Website").
By purchasing any Products, you agree to the following terms and conditions:
- License.
- When you purchase a Product, you are granted a non-exclusive, royalty-free license to use the Product in your personal or commercial projects (subject to the exceptions listed below). All underground releases are automatically cleared.
- You do not own the Product, and all copyrights remain with Adam Deitch.
- Usage. You may use the Products in:
- Music production (albums, singles, etc.)
- Live performances
- Video or film projects
- Podcasts or multimedia projects
- Prohibited Uses. You may not:
- Claim ownership of the original sounds created by Adam Deitch
- Use the Products to create a similar competing sample pack
- Share the Products with others (including uploading to file-sharing sites)
- Resell, redistribute, or share the raw files of the Products in any form
- Royalty Free vs. Royalty. You never have to pay anything out of pocket AFTER the purchase and download of a Product. However, “back-end” royalties will be due licensor in the following limited situations where you are earning substantial revenues from the Product (“Royalty Exception”):
-Any release generating over 1 million streams
- Major Label Placements
- Large Sync Placements containing the drum breaks, fills or melodic loops
In a Royalty Exception situation, additional clearance will be required from licensor which will generally involve:
-A customary Publishing share required
-Customary Points on the Master
In a Royalty Exception situation, please contact licensor at the following e-mail address [info@regimeinc.com] and the parties will work out a in good faith a split that is fair under the applicable circumstances (but licensor’s rate would never be less than 5%).
- No Refunds.
Due to the nature of digital downloads, all sales are final, and no refunds will be provided after purchase.
- Indemnity.
You agree to indemnify and hold Adam Deitch harmless from any claims or disputes that may arise from your use of the Products.
- Disclaimer of Warranties.
The Products are sold on an “AS IS” basis, without any warranties.
- Limitation of Liability.
Adam Deitch shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Products.
- Governing Law.
This Agreement is governed by the laws of Colorado. Any disputes will be resolved in the courts of Colorado.
You acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
